What is an Emotional Support Animal Letter?

An ESA letter is a formal clinical document issued by a licensed mental health professional (LMHP) — such as a therapist, psychologist, or psychiatrist — that states two things: that you have a qualifying mental health condition, and that an emotional support animal provides genuine therapeutic benefit for that condition.

It is important to understand what an ESA letter is not. It is not a certification, registration, ID card, or vest. There is no official government registry for ESAs. The letter itself — written on a licensed provider's letterhead, signed, and dated — is the only recognized documentation for housing accommodations under the Fair Housing Act.

Fair Housing Act

Your Housing Rights with an ESA

The Fair Housing Act (FHA) provides important protections for individuals with disabilities who use emotional support animals. Understanding these rights can help you navigate housing situations more confidently.

Reasonable Accommodation

Landlords and housing providers are generally required to provide reasonable accommodation for individuals with a qualifying disability, including allowing an ESA.

No Pet Fees or Deposits

Under the FHA, housing providers generally cannot charge additional pet fees, deposits, or surcharges for an emotional support animal.

No-Pet Policies

A standard no-pet policy cannot be used to deny housing to a person with a legitimate ESA letter and qualifying condition.

Broad Application

FHA protections apply to most housing types including apartments, condos, cooperatives, and many single-family homes.

Housing rights depend on individual circumstances and specific housing types. ESA Crew does not provide legal advice. Consult a qualified legal professional for questions about housing disputes.

Frequently Asked Questions

Clear answers to common questions about the ESA process and your rights.

No. An ESA letter is a clinical recommendation document, not a prescription. It states that you have a qualifying mental health condition and that an emotional support animal provides therapeutic benefit.

The online assessment takes 5–10 minutes. Consultations are typically available within 1–3 business days. If approved, your letter is delivered digitally within 24 hours.

Under the Fair Housing Act, landlords are generally required to provide reasonable accommodation for a valid ESA letter. However, specific circumstances may vary. Consult a legal professional for disputes.

Most common household pets can qualify as ESAs, including dogs, cats, and other small animals. The key requirement is that the animal provides emotional support that benefits your mental health condition.

No. ESAs do not have public access rights under the ADA. Only Psychiatric Service Dogs (PSDs) that are task-trained have public access rights. ESAs are protected under the FHA for housing only.

An ESA letter is typically valid for one year from the date of issue. Annual renewals are available to maintain your housing protections.

If your provider determines that a letter is not clinically appropriate, you will still receive a complete evaluation record. You may seek a second opinion or re-evaluate in the future.

ESA letters are primarily for housing accommodations under the FHA. Airlines are no longer required to accommodate ESAs. If you need travel accommodations, consider a PSD evaluation.
